The hearing of the Minister’s appeal of our clients’ historic duty of care ruling played out over a three day hearing in the Full Court of the Federal Court of Australia from 18-20 October 2021.
Our barristers put detailed arguments to the Court on the science of climate change, on why every coal project is critical, and what people in power should do to guard against the climate crisis.
The Minister argued, amongst other things, that the decision to approve the mine was ultimately a policy decision and the Court should not intervene.
There was a lot at stake. An immense amount of work was done by the whole legal team to give it our best shot.
5,400 people kindly chipped into our clients’ crowdfunding campaign, which raised $330,000. This was the community in action fighting for a safe future for our children against the might of the Australian government – a government that argued the Environment Minister does not have a duty to avoid harming children.

The Full Court’s judgment is now reserved. It should be published in the coming months.
